These terms also exist in German. Both versions say the same; if they ever differ, the German version applies.
These Terms of Service apply to the use of the “Two Wheels Apart” apps for iOS and Android and the website twowheelsapart.com (together “Two Wheels Apart”). The provider is Julian Henke, Gleesener Hauptstraße 6, 48488 Emsbüren, Germany (see Imprint ), “we” below.
The core features – the map, riders nearby, spots, tracks, messages and hosting – are free. We may offer additional features as a paid “Two Wheels Apart Pro” subscription (section 9). You can look at the map without an account. By registering an account, you enter into a usage agreement with us on these terms.
You can create an account with an email address and a password, or with Sign in with Apple or Sign in with Google. You then choose a username and a display name, and we ask you to confirm your email address. Two Wheels Apart is only for people aged 18 or older: by registering, you confirm that you are at least 18 years old. This is not verified technically but relies on your declaration; a false declaration violates these terms. For hosting you confirm your age once more in the app (section 8). Keep your login details secret; an account is personal and cannot be transferred.
When using Two Wheels Apart, you agree
What you post on Two Wheels Apart – spots, photos, descriptions, tracks, expeditions, comments, border crossing reports, references, messages – stays yours. You confirm that you hold the necessary rights and that no third-party rights stand in the way; people recognisable in photos must agree to their publication.
So that we can show your content, you grant us a simple, free, worldwide right to store it, adapt it technically (for example resize and re-encode photos), reproduce it and make it available in the apps to the users you make it visible to. The right ends when you delete the content or your account, except for the archived copies of deleted spots and the backups described in the Privacy Policy, for as long as they exist. We do not sell your content or pass it on to anyone for their own purposes. Riders who download a shared track may use it for their own rides only, not republish it. Photos you add to the gallery of someone else’s spot can be hidden by the rider who created the spot.
Reporting. You can report spots, photos, tracks, hosts, profiles, photo posts, comments and conversations in the app. Anyone, including people without an account, can also report content they consider illegal to support@twowheelsapart.com. A report should say where the content is (for example the name of the spot or track, or the username), why it is illegal, your name and email address (except for reports of certain offences such as child sexual abuse material), and confirm that your information is accurate and complete to the best of your knowledge. We confirm reports by email, review them promptly, diligently and objectively, and tell you our decision.
How we moderate. We do not check content before it appears. Reports are reviewed by a person. The only automatic step: content reported by several different accounts is hidden until it has been reviewed (spots and photos after three reports, tracks after two); hosts are paused after two reports. We may remove or hide content that breaks the law or these terms; for violations we may warn accounts, suspend them temporarily or exclude them permanently, for serious violations without prior warning. Anyone who repeatedly shares manifestly illegal content or repeatedly sends manifestly unfounded reports may, after a warning, be suspended for a reasonable period. In doing so we take into account the severity of the violation and the legitimate interests of everyone involved, including freedom of expression and information.
Reasons and objection. If we remove or restrict your content or your account, we tell you by in-app message or email what we decided, which facts and which legal provision or rule of these terms we rely on, whether automated means were involved, and which remedies you have – unless it is deceptive high-volume commercial content (spam) or the law forbids telling you. You can object to the decision by replying to it or writing to the address above; a person will then review it again. You can always go to the courts.
Blocking. You can block other users at any time: you then no longer see each other’s positions, messages stop in both directions, and you do not see each other in comments.
Notices from rights holders. If you are the author or rights holder of content, for example a route, and did not allow it to be shared, write to us with the name of the content and a short explanation. We remove content promptly once we learn of an infringement.
Spots, tracks, descriptions, photos, border crossing reports and all other content from users are not our own content. We do not check them in advance and give no guarantee as to their accuracy, currency, completeness or legality.
This applies in particular to places marked as a “wild camp”: wild camping, or camping outside designated sites, is not permitted everywhere, the rules differ from country to country and region to region, and they can change at any time. Likewise, many tracks, trails and forest roads may not be ridden by motorcycle. It is your own responsibility to check the rules that apply locally and to judge the legality and safety of a place or route yourself. The entry and travel information in the app comes from the German Federal Foreign Office; only the embassy of the country concerned gives binding information.
Routes, distances, travel times and turn instructions are calculated automatically from map data and can be wrong, incomplete or out of date. They are suggestions: traffic rules, road signs and the actual conditions on the road always come first. Only operate your phone while riding as far as traffic rules allow, and plan routes before you ride where possible. Other users’ positions are intentionally imprecise and not exact positions.
Riders can offer other riders a place to sleep and ask hosts for a night. Two Wheels Apart only connects riders: we are not a party to any stay, do not arrange accommodation for money and do not inspect homes or guests beyond the profile checklist. Hosts and guests are responsible for their own conduct; our own liability is governed by section 11. Staying is always free – nobody may ask for or accept money for a stay arranged through the app.
Hosting and asking to stay are open to verified profiles only (confirmed email address, profile photo, 18 or older, an account at least seven days old). When you meet people you got to know through the app, use your own judgement and look after your safety and your belongings; report problems through the report function. Give honest references and do not pass a host’s exact location on to anyone. As a host you are responsible for being allowed to take in guests (for example under your tenancy or property rights). A host can pause or stop hosting at any time; a stay can be cancelled by either side.
Purchase. You buy Pro as an in-app subscription through Apple’s App Store or Google Play. The terms of the respective store also apply to purchase, payment, renewal, cancellation and refunds. Price, duration and any free trial are shown in the app and in the store before you buy; prices include statutory VAT.
Duration and cancellation. The subscription runs for one month or one year and renews automatically for the same period unless you cancel it beforehand. You can cancel at any time in the subscription settings of your Apple account (at least 24 hours before the period ends) or in Google Play under “Payments & subscriptions”; Pro stays active until the end of the period already paid. A free trial turns into a paid subscription unless you cancel before it ends. Deleting your account or the app does not cancel the subscription.
Platform. In the iOS app, Pro is tied to the Apple ID you bought it with; in the Android app, to your Two Wheels Apart account. A subscription currently applies only on the platform you bought it on.
Withdrawal and refunds. Refunds and withdrawal are handled by Apple or Google under their terms; that is also where you find the withdrawal information for store purchases. Your statutory consumer rights, including the legal warranty for digital products, remain unaffected.
Changes. We may change Pro features if there is a valid reason (for example a change in the law, security, technical development or a map service being discontinued), it costs you nothing extra and we inform you clearly. If a change affects your access to Pro or its usability more than insignificantly, we inform you in good time beforehand, and you can end the subscription under the statutory rules (Sec. 327r German Civil Code). Price changes are made only through the respective store and under its rules.
We aim for smooth operation but cannot guarantee constant availability, for example during maintenance, outages of map services or events beyond our control. We may develop, change or discontinue free features; we announce significant restrictions in the app beforehand.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee. For slight negligence we are liable only for breach of an essential contractual obligation (one whose fulfilment makes the proper use of Two Wheels Apart possible in the first place and on which you may regularly rely), limited to the damage typical for this kind of contract and foreseeable when it was concluded. Otherwise, liability for slight negligence is excluded. The statutory warranty for Pro remains unaffected.
You can end the usage agreement at any time without giving a reason by deleting your account in the app (Profile → gear → “Info and privacy” → “Delete my account”) or by asking for deletion by email ( how it works ). Deletion is immediate and permanent; what is deleted is described in the Privacy Policy. You cancel a Pro subscription separately in the store.
We may terminate the agreement for free use with four weeks’ notice; a paid Pro subscription remains unaffected until the end of the period already paid. The right of both sides to terminate for good cause, for example for serious or repeated violations of these terms, remains unaffected.
We may adjust these terms, for example when features or the law change. We tell you about changes at least four weeks before they take effect, in the app or by email. Changes that put you at a disadvantage or affect the balance between what we provide and what you pay apply only if you agree to them. If you do not agree, you can delete your account at any time. The current version is always available on this page.
These terms are governed by the law of the Federal Republic of Germany. Mandatory consumer protection rules of the country where you have your habitual residence remain unaffected. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
Questions about these terms, reports and objections go to support@twowheelsapart.com. This address is also the single point of contact for users, authorities and the European Commission under Art. 11 and 12 of the Digital Services Act; you can write to us in German or English.
